By booking or participating in any class or activity at Shine Hot Pilates, you acknowledge and agree that you have read and will abide by these terms and conditions:

MEMBER SERVICES AND POLICIES

Cancellation Policy

You must cancel class 12 hours in advance or you will be deducted from that class. Members will be charged a $15 late cancellation charge.

This includes switching time slots under the 12-hour notice time period. You may cancel the class through the online system or by calling the studio directly.

Members who do not show up for a class at all will be charged a $25 fee.

RESERVATION

You must be physically present 5 minutes prior to the start of your scheduled class or your spot may be given to a client on the waitlist.

PERSONAL PROPERTY

You agree that Shine Hot Pilates is in no way responsible for the safekeeping of, or any theft, loss, or damage to your personal property while you are present in the studio. You assume all risk of loss for any of your personal property and release Shine from any related claims to the maximum extent allowed by law.

STUDIO RULES + REGULATIONS

You must be physically present and checked in 5 minutes prior to the start of class, or your spot may be released to a client on the waitlist.

HEALTH + SAFETY DISCRETION

BEFORE USING ANY OF OUR EXERCISE PROGRAMS, YOU AGREE TO CONSULT WITH YOUR PHYSICIAN OR HEALTH CARE PRACTITIONER TO DETERMINE IF YOU ARE HEALTHY ENOUGH TO USE AND FOLLOW OUR EXERCISE PROGRAMS. YOU ALSO AGREE TO FOLLOW ALL SAFETY INSTRUCTIONS WHEN USING OUR EXERCISE PROGRAMS.

You are aware of and acknowledge the potential risks connected with activity in any exercise, physical fitness, or training program and have made an informed decision as to whether or not you should participate in these types of activities.

The Shine Hot Pilates program you are about to begin utilizes weights and other equipment which, if not used correctly, could lead to serious injury. For your safety, you must use any equipment shown in the workouts only as demonstrated, inspect any equipment prior to each use and refrain from using any equipment that appears damaged, worn or defective.

Improper form or use of equipment can cause serious and permanent injury. Always make sure your exercise area is clear of any obstacles, including pets, children, other people, or equipment not currently in use.  By using this program, you assume all dangers, hazards, and risks of injury in the use of this program.  If at any time you feel you are exercising or moving beyond your current abilities, or you feel any overheating, discomfort, pain, dizziness, or nausea, you should discontinue exercise immediately and notify a health care provider. If you are feeling overheated take breaks, drink water, and leave the room when necessary. 

Reserved classes must be changed or canceled within 12 hours of the scheduled time, or they will be forfeited.

Membership packages are subject to a penalty fee for a late cancellation or absence. 

If recovering from an injury or illness, notify the instructor prior to the start of class and make necessary modifications.

REFUND POLICY

CLASSES + MEMBERSHIPS

All classes and membership packages are non-refundable. No exceptions.

Retail items

Unused merchandise will be accepted for an in-store credit or merchandise exchange within 14 days of purchase. After 14 days, a store credit will be issued for up to 30 days. No exchanges will be accepted without a receipt.

TERMINATION

We may terminate your access to the site, without cause or notice, which may result in the forfeiture and destruction of all information associated with you. All provisions of this Agreement that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

THIRD-PARTY SITES

Our Site may contain links to third-party sites that are not owned or controlled by ShineLikeADiamond LLC

ShineLikeADiamond LLC has no control over and assumes no responsibility for, the content, privacy policies, or practices of any third-party sites or services. We strongly advise you to read the terms and conditions and privacy policy of any third-party site that you visit.

GOVERNING LAW

This Agreement (and any further rules, policies, or guidelines incorporated by reference) shall be governed and construed in accordance with the laws of Texas, USA, without giving effect to any principles of conflicts of law.

CHANGES TO THIS AGREEMENT

We reserve the right, at our sole discretion, to modify or replace these Terms of Service by posting the updated terms on the Site. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms and Conditions.

We encourage you to review this Agreement periodically for changes. If you do not agree to any of this Agreement or any changes to this Agreement, do not use, access, or continue to access the Site or discontinue any use of the Site immediately.

ELIGIBILITY

Membership is void where prohibited. This website is intended solely for Users who are 16 years of age or older. Any registration by, use of, or access to the website by anyone under 16 is unauthorized, unlicensed, and in violation of these Terms and Conditions.

By using Shine Hot Pilates services or the website, you represent and warrant that you are 16 years of age or older and that you agree to abide by all of the Terms and Conditions. Minors between the ages of 16 and 18 may register on our website only with the involvement of a parent or guardian.

RELEASE AND INDEMNITY

In consideration of performing or participating in our exercise programs, you hereby fully and finally release and agree to indemnify, defend, and hold harmless ShineLikeADiamond, LLC, and its members, managers, employees, agents, and representatives against any loss, liability, damage, personal injury, property damage, cause of action, cost, or expense of any nature whatsoever, including without limitation reasonable attorneys’ fees and other legal costs, arising from your use of Shine’s facility or equipment, or participation in any Shine exercise class or program.

TERMS

These Terms and Conditions shall remain in full force and effect while you use the Shine Hot Pilates Services or are a Member. You may terminate your membership at any time, for any reason, by following the instructions provided or by contacting the studio directly via phone or email. Shine Hot Pilates may terminate your membership at any time, without warning, if you breach these Terms and Conditions. Even after membership is terminated, these Terms and Conditions will remain in effect.

FEES

You acknowledge that Shine Hot Pilates charges fees for its services, and Shine Hot Pilates reserves the right to change its fees from time to time at its discretion. If Shine Hot Pilates terminates your membership because you have breached these Terms and Conditions, you may not be entitled to a refund of any unused portion of your membership or other fees.

These Terms of Service have been created and are effective as of August 30, 2019.

PAYMENT SUMMARY

Monthly memberships are paid in advance monthly, on the calendar date on which the membership became activated, for the following month.

Class packages are billed in full at the time of purchase. Regular monthly dues apply thereafter. Monthly membership payments shall be made on the first day of each month, on a month-by-month basis, via automatic debited payment (credit card, debit card, or automatic checking account draft). Additional terms regarding the automatically debited payments are outlined below.

In the event of a declined credit card/debit card, the member’s account will be immediately suspended, pending the member updating their payment information and their membership dues paid in full.
